Halle Berry Beats Gabriel Aubry in Court Over Custody Issue

Halle Berry just won a victory in her ongoing custody struggle withGabriel Aubry.

A judge granted Berry permission to shoot the movie New Year’s Eve in New York – and to take the couple’s daughter Nahla with her.

Aubry had challenged Berry’s cross-country trip with Nahla, but, after hearing arguments from both sides, the court gave Berry the green light.

Before today’s judgment, Berry had ceded her role in the film toKatherine Heigl in order to stay in Los Angeles and deal with the custody issues.

She’ll reportedly now play another role in New Year’s Eve.

The battle over Nahla has become particularly ugly in recent weeks.

Aubry has now withdrawn his custody petition, but is pursuing a paternity action.

Halle Berry and Gabriel Aubry’s bitter custody battle over their young daughter Nahla has now entered even more sensitive territory.

Amid allegations that Aubry (who is white)called Berry the “N word,” Berry discusses Nahla’s racial identity in the new issue of Ebony magazine – and makes a strong statement.

“I feel like she’s black. I’m black and I’m her mother, and I believe in the one-drop theory,” says Berry.

Historically speaking, the “one-drop theory” contends that an individual with even “one drop” of African ancestry should be considered black.

“I’m not going to put a label on it,” continues the actress. “I had to decide for myself and that’s what she’s going to have to decide – how she identifies herself in the world.”

“And I think, largely, that will be based on how the world identifies her. That’s how I identified myself. But I feel like she’s black.”

A toddler’s racial makeup wouldn’t usually be discussed quite so publicly, but as Berry and Aubry’s fight becomes more intense, so too has the focus on Aubry’s personal beliefs.

According to reports, Aubry “went nuts” whenever someone referred to Nahla as “black.”

The incident angered Berry, according to People.

She is said to have been upset at the prospect of a reality star like Kardashian, always surrounded by cameras, being in the life of Nahla, her two-year-old daughter with Aubry.

Concern about Nahla’s exposure, more than jealousy, supposedly created Berry’s discomfort with a potential Kardashian-Aubry relationship.

While Kardashian and Aubry have since gone their separate ways, the custody battle over Nahla has turned very ugly, with Berry alleging that Aubry called her the “N word” and barraged her with abusive text messages

Now it’s emerging that Aubry allegedly called Berry the “N” word, and barraged her with vulgar and offensive text messages.

After news came out about it, a second Berry source, who was shocked the information was leaked, confirms to MC, “It is true.”

Halle Berry is gearing up for a battle with Gabriel Aubrey over their two-and-a-half year-old daughter, Nahla.

On December 30, Aubrey filed court papers seeking joint custody and to be formally recognized as the child’s father.

Now, Berry is fighting back.

“Halle has serious concerns for her daughter’s well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her,” her rep tells MC.

In fact, Berry has even pulled out of the film New Year’s Eve to focus on the “pending custody litigation involving her daughter,” says the rep.

“She has attempted to resolve these custody issues amicably with her daughter’s father, Gabriel Aubry, directly,” adds Berry’s spokesperson, “but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention.”
